Welcome to My Money Story! These Terms of Service (this “Agreement”) govern your use of the financial empowerment service provided by My Money Story PBC (“My Money Story”, “we”, or “us”), any website at or subdomains of the mymoneystory.com domain name and any other linked pages, features, or content, or services offered from time to time by My Money Story in connection therewith (collectively, the "Website" and together with the financial empowerment service, the “Service”). Please read this agreement carefully before accessing or using the Service. Each time you access or use the Service, you agree to be bound by this Agreement. If you do not agree to be bound by this Agreement, you should not access or use the Service. In addition, certain elements of the Service may be subject to additional terms of use. If any of the additional terms of use governing such elements conflict with this Agreement, the additional terms will control.
This Agreement applies to all users of the Service for any purpose (“Users”). This Agreement is void where prohibited by law, and the right to access the Service is revoked in such jurisdictions.
Personal Information.
For information regarding My Money Story’s treatment of personal information, please review My Money Story’s current Privacy Policy, which is hereby incorporated by reference. Your acceptance of this Agreement constitutes your acceptance and agreement to be bound by My Money Story’s Privacy Policy.
Connecting Users with each other for peer-to-peer conversations about financial intentions, barriers, and goals is an important part of the Service. We ask that you provide us with enough accurate information to help you connect with other Users (“Peers”) either one-on-one or in small groups based on shared experiences, intentions, and goals. It is a requirement of this Agreement that you keep your Peer conversations private, and otherwise act responsibly and respectfully toward your Peers and My Money Story personnel, and you agree to do so.
You acknowledge that certain information in your Account profile will be visible to your Peers in your conversations with them, that you will be publicly identified by your Account profile name when communicating with your Peers on the Service, and that conversations with your Peers and My Money Story Personnel will necessarily contain personal information about you. Specifically, your Peers will be able to see your:
First name;
City and State;
Age;
Income range ;
Financial goals (selected from a drop down);
Financial dependents (who you support financially);
Information about what may be causing you stress and/or your level of confidence about your financial situation; and
Anything else you choose to share with your Peers (we provide an open text field).
We encourage you to use reasonable caution about what kinds of information you share (for example, do not provide your address, personal identification numbers, or any kind of account information in conversations with your Peers).
Access to the Service
Basic Conditions. The Service is owned and operated by My Money Story. The Service is provided solely for your own use, and not for the use or benefit of any third party. My Money Story may change, suspend or discontinue all or any of the Service at any time. My Money Story may also impose limits on certain features and services or restrict your access to parts or all of the Service without notice or liability except as expressly set forth herein. My Money Story reserves the right, in its sole discretion, to modify this Agreement at any time by amending this Agreement in writing and providing notice through the Service or via email. You shall be responsible for reviewing and becoming familiar with any such modifications. Your use of the Service following such notification constitutes your acceptance of the terms and conditions of this Agreement as modified, subject to your termination right set forth below.
Registration and Security. As a condition to using all or some aspects of the Service, you will be required to create a User account (your “Account”) by registering with My Money Story. To register and create your Account, you must provide your name, zip code, an email address, a mobile telephone number, and a User name. We may also require a password. My Money Story has a strict real name requirement. You agree that you will provide to My Money Story the full name (first and last) by which you are most commonly known.
As part of your Account setup, we also ask that you provide us with certain demographic information (birthday, preferred pronouns, marital status, education level, and race) and financial habit information (financial goals, who you support financially, income information, and spending habits). We may also ask for information about what may be causing you stress and/or your level of confidence about your financial situation. We also provide an open field for you to share any other information you may wish (subject to the conditions in the Code of Conduct below) You may also provide a photograph for your Account profile.
Certain elements of your Account (your “Profile”) will be shared with your peers under certain circumstances as described above under “Personal Information” (e.g., your User name and first name will be shared in conversations with your Peers).
You shall provide My Money Story with accurate, complete, and updated registration information. Failure to do so shall constitute a breach of this Agreement, which may result in immediate termination of your account. My Money Story reserves the right, in its sole discretion, to refuse to establish an account. You shall be responsible for maintaining the confidentiality of any credentials or means you use to access the Service.
We also need enough accurate information about your past and present financial intentions, barriers, and goals to be able to connect you with appropriate Peers, and provide you with appropriate goal-tracking and motivational assistance. We ask that you fill out our new User questionnaire honestly and completely.
Persons Under 16; Your Right to Enter into a Contract. My Money Story does not knowingly collect or solicit personal information from anyone under the older of the age of 16 or the age of majority in their jurisdiction (“Minimum Age”) or knowingly allow such persons to register for the Service. If you are under the Minimum Age, please do not attempt to register for the Service or send any information about yourself to us, including your name, address, telephone number, or email address. No one under the Minimum Age may provide any personal information to My Money Story or on the Service. If we learn that we have collected personal information from a person under the Minimum Age without verification of parental consent, we will delete that information as quickly as possible. If you believe that we might have any information from or about a person under the Minimum Age, please email us at support@mymoneystory.com.
Your Basic Commitments. You represent and warrant to My Money Story that: (i) the individual entering into this Agreement has the authority to enter into this Agreement, including on behalf of you as an entity; (ii) all registration information you submit is accurate and truthful; and (iii) you will maintain the accuracy of such information. You certify that you are legally permitted to use and access the Service. You agree that you will not allow anyone to use your Account without your knowledge or permission, and that you take full responsibility for the selection and use of and access to the Service in connection with your Account.
Payments
Fees and Payment. Certain elements of the Service may require payment, as described in our Fee Schedule. My Money Story reserves the right to require payment of fees for certain or all elements of the Service. You shall pay all applicable fees. My Money Story reserves the right to change its Fee Schedule and to institute new charges at any time, upon notice to you, which may be sent by email or posted within the Service. Your use of the Service following such notification constitutes your acceptance of any new or increased charges. Any fees paid hereunder are non-refundable except as stated in this Agreement.
Payment Processor. My Money Story uses a third-party payment processor (the “Payment Processor”). My Money Story’s current Payment Processor is Stripe. The processing of payments will be subject to the terms, conditions and privacy policies of the Payment Processor in addition to this Agreement. The terms and conditions of the Payment Processor may be found at https://stripe.com/legal/ssa; the Payment Processor’s Privacy Policy may be found at https://stripe.com/privacy. My Money Story is not responsible for errors made by the Payment Processor, or otherwise in connection with the processing of transactions. By choosing to use paid elements of the Platform, you agree to pay and receive payment through the Payment Processor.
Current Payment Information. YOU MUST PROMPTLY UPDATE AND MAINTAIN THE ACCURACY OF ALL INFORMATION TO ENABLE THE COMPLETION OF YOUR TRANSACTION (SUCH AS A CHANGE IN BILLING OR PAYMENT ADDRESS, BANK ACCOUNT INFORMATION, CREDIT CARD NUMBER, OR CREDIT CARD EXPIRATION DATE), AND YOU MUST PROMPTLY NOTIFY US IF YOUR FORM OF PAYMENT IS CANCELED (E.G., FOR LOSS OR THEFT) OR IF YOU BECOME AWARE OF A POTENTIAL BREACH OF SECURITY, SUCH AS THE UNAUTHORIZED DISCLOSURE OR USE OF A CREDIT OR DEBIT CARD, BANKING INFORMATION, OR YOUR PERSONAL INFORMATION.
Service Content, Use and General Terms
Service License. Subject to your compliance with this Agreement, our Privacy Policy, and any other policies or agreements referenced herein, My Money Story hereby grants to you a limited, non-exclusive, non-assignable, non-transferable, and revocable limited right and license to establish, access and use your Account with the Service.
Limited License to My Money Story Content. The Service and the contents thereof are owned by My Money Story and its licensors, are intended solely for the use of Users, and may only be displayed and used by you in accordance with the license to the Service above. All materials displayed or performed on the Service (including, but not limited to text, graphics, articles, photographs, images, illustrations—also referred to in this Agreement as the “Content,” and which includes User Submissions (as defined below)—are protected under the United States Copyright Act. You shall abide by all copyright notices, trademark rules, information, and restrictions contained in any Content, software or materials in the Service and shall not use, copy, reproduce, modify, translate, publish, broadcast, transmit, distribute, perform, upload, display, license, sell, create derivative works based on, perform, or in any way exploit, any of the Content, software, materials, or Service in whole or in part: (i) without the express prior written consent of the respective owners, and (ii) in any way that violates any third party right.
License of User Submissions to My Money Story. In the course of using the Service, you and other Users may provide information which may be used by My Money Story in connection with the Service and which may be visible to certain other Users. You understand that by posting information or content on the Service or otherwise providing content, materials or information to My Money Story or in connection with the Service (collectively, “User Submissions”), you grant My Money Story a non-exclusive, worldwide, royalty free, sublicenseable and transferable right and license to host, use, distribute, modify, copy, perform or display, translate, and create derivative works of your User Submissions only to the extent, and for the period necessary to provide the Service; however, My Money Story will only share your personal information in accordance with My Money Story’s Privacy Policy. This license will be perpetual as to any information we have already published or shared with a Sponsoring Organization in accordance with the Privacy Policy, but otherwise, the license to your Submissions ends when your Submissions are deleted from the Service. You can delete all of your Member Content at once by deleting your Account as described under “Termination” below. You warrant that you possess all rights necessary to provide your User Submissions to My Money Story and to grant the rights above in connection with the Service.
Trademarks. My Money Story retains all right, title and interest in and to its trademarks, logos and service marks (“My Money Story Trademarks”) used and displayed in the Service. Other marks and names in or on the My Money Story Content may be third-party trademarks and service marks (“Third-Party Trademarks”). You agree that you will not in any manner damage the goodwill associated with the My Money Story Trademarks and/or the Third-Party Trademarks. You acknowledge and agree that any goodwill received from the use of any My Money Story Trademarks and/or Third-Party Trademarks will be for the sole benefit of My Money Story or the relevant Third-Party.
Content Disclaimers. You understand that all information publicly posted or privately transmitted through the Service is the sole responsibility of the person from which such information originated and that My Money Story will not be liable for any errors or omissions in any such Content. You understand that My Money Story cannot guarantee the identity of any other Users with whom you may interact in the course of using the Service. Additionally, My Money Story cannot guarantee the authenticity of any information that Users may provide about themselves. You acknowledge that all Content accessed by you using the Service is at your own risk and you will be solely responsible for any damage or loss to any party resulting therefrom.
Under no circumstances will My Money Story be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred in connection with use of or exposure to any Content accessed, transmitted, or otherwise made available via the Service.
Code of Conduct
Community. In connection with the use of the Service’s interactive features, you agree that you will follow our Community Guidelines, as we may update them from time to time. To emphasize the basic obligations of those community guidelines:
Be respectful — Please don't engage in making inflammatory, offensive, harshly critical, or insulting comments to others.
Protect others’ privacy — Keep personal information about anyone else private, including their names, home addresses, phone numbers, and email addresses.
Protect your own privacy — Be careful about the personal information you disclose about yourself. Be careful about agreeing to communicate or meet with other Users outside of the Service.
Report inappropriate content — If you see something that you feel violates our guidelines, please alert us right away.
General. In addition to compliance with the Community Guidelines, you agree that you will not, and will not encourage or assist others to:
submit, post, or upload any advertisements or promotional content, whether for yourself or any other Service, provided that you may recommend products, services or service providers that you have personally used, and for which you recommendation you do not receive any form of compensation;
contribute, upload and/or distribute any material consisting of or promoting any contests, surveys, chain letters, sweepstakes, unsolicited electronic communications, pyramid schemes, or other fraudulent, predatory, illegal or impermissible communications;
contribute, upload and/or distribute any material that you are reasonably aware is false;
access the Service for the purpose of obtaining data or information about other Users;
impersonate another User on the Service, or otherwise misrepresent (including by omission) your identity or your affiliation with a third party, or allow another person to impersonate you on your Account;
engage in any harassing, bullying, stalking, threatening, misleading, intimidating defamatory, derogatory, racist, or in any way hurtful or malicious conduct (“Malicious Communication”);
except with the express consent of the relevant person, use any contact information for persons made available through the Service except within the Service;
contact any User who has indicated that they do not wish you to contact them;
contribute, upload and/or distribute any material that is profane, defamatory, obscene, pornographic, offensive, contains nudity, harmful towards any kind of individual or group of individuals, or is in any way unlawful;
contribute, upload and/or distribute any material that is disrespectful toward a political or religious belief or position, or which is disrespectful toward a person or group of people based on your or their religious or political belief or position;
contribute, upload and/or distribute any material which infringes any third party intellectual property, privacy, or publicity rights;
violate any applicable laws on a local, national, or international level, including without limitation export control and antidiscrimination laws;
contribute, upload and/or distribute any material that includes a person’s name, likeness, voice, image, biographical material, location, or any other identifying features (“Personal Content”) without the written consent of the person associated with Personal Content;
contribute, upload and/or distribute any Personal Content of any person under the age of eighteen (18) years without written consent from their parent or guardian;
decompile, reverse engineer, or otherwise attempt to obtain the source code of any element of the Service;
modify, use, reproduce, copy, publish, download, distribute, exploit transform or reconfigure any Content except your own User Submissions;
contribute, upload and/or distribute any material that contains viruses, bugs, Trojan horses, or any corrupted files that can infiltrate the operation of the Service and/or any other User’s computer;
interfere with any other User’s access to the Service;
contribute, upload and/or distribute any material that implies or states that you or the relevant material are endorsed by My Money Story;
run a mail list, listserv, any form of auto-responder, nor use the Service to send or route "spam" nor run any processes that otherwise interfere with the proper working of or place an unreasonable load on the Service infrastructure;
use a spider, robot, or any other manual or automatic system to data-mine, scrape, data-crawl or index the Service in any capacity except as expressly permitted by the Service’s robots.txt file and/or access-rights metatags;
evade or disable any of the Service’s security or access controls, or access the Service’s functionality, servers, or any connected networks without authority to do so, or interfere with the functionality of any element of the Service, or use the Service to attempt any of the above with third party systems;
alter and/or remove any trademarks, proprietary marks or rights notifications owned by My Money Story, any third party, or any User; or
seek or provide advice on engaging in illegal activities or bad practices, including how to work around/violate My Money Story’s policies.
You are responsible for all of your activity in connection with the Service. My Money Story reserves the right (but not the obligation), in its sole discretion, to determine whether you have violated this Code of Conduct or any other provision of these terms, and can suspend or deny your access to the Service in its sole and absolute discretion, without any notice to you.
Warranty Disclaimer
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE, MY MONEY STORY CONTENT, AND ANY OTHER PRODUCTS OR SERVICES PROVIDED BY MY MONEY STORY ARE PROVIDED ON AN "AS IS" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT USE OF THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. MY MONEY STORY EXPRESSLY DISCLAIMS ANY WARRANTIES CONCERNING ANY INTERACTION BETWEEN USERS.
Indemnity
You will indemnify and hold My Money Story, its parents, subsidiaries, affiliates, officers, and employees harmless (including, without limitation, from all damages, liabilities, settlements, costs and attorneys' fees) from any claim or demand made by any third party, or any dispute between you and any other User or third party, due to or arising out of your access to or use of the Service, your violation of this Agreement, or the infringement by you (or any third party using your Account) of any intellectual property or other right of any person or entity.
Limitation of Liability
YOUR INTERACTIONS WITH OTHER USERS THROUGH OR IN ANY WAY IN CONNECTION WITH THE SERVICE ARE SOLELY BETWEEN YOU AND SUCH USERS, AND YOU AGREE THAT MY MONEY STORY IS UNDER NO OBLIGATION TO INVOLVE ITSELF IN SUCH INTERACTIONS. YOU AGREE THAT MY MONEY STORY SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY LOSS OR DAMAGE OF ANY SORT INCURRED AS THE RESULT OF ANY SUCH INTERACTIONS. YOU HEREBY RELEASE MY MONEY STORY FROM ALL CLAIMS ARISING FROM ANY INTERACTION BETWEEN YOU AND ANY OTHER USER.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MY MONEY STORY, OR ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE WITH RESPECT TO THE SERVICE OR THE SUBJECT MATTER OF THIS AGREEMENT UNDER ANY CONTRACT, NEGLIGENCE, TORT, STRICT LIABILITY OR OTHER LEGAL OR EQUITABLE THEORY (I) FOR ANY AMOUNT IN THE AGGREGATE IN EXCESS OF THE GREATER OF $100 OR THE FEES PAID BY YOU FOR THE SERVICE DURING THE 12 MONTH PERIOD PRECEDING THE APPLICABLE CLAIM; (II) FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER; OR (III) FOR ANY MATTER BEYOND MY MONEY STORY'S REASONABLE CONTROL.
THE LIMITATIONS OF LIABILITY SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN MY MONEY STORY AND YOU, AND SHALL APPLY TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW.
Third-party Websites. The Service may contain links to third party websites or services ("Third Party Services") that are not owned or controlled by My Money Story, or the Service may be accessible by logging in through a Third Party Service, as described more fully in our Privacy Policy. When you access Third Party Services, you do so at your own risk. You hereby represent and warrant that you have read and agree to be bound by all applicable policies of any Third Party Services relating to your use of the Service and that you will act in accordance with those policies, in addition to your obligations under this Agreement. My Money Story has no control over, and assumes no responsibility for, the content, accuracy, privacy policies, or practices of or opinions expressed in any Third Party Services. By using the Service, you expressly relieve and hold harmless My Money Story from any and all liability arising from your use of any Third Party Website.
Termination. This Agreement shall remain in full force and effect while you use the Service. You may terminate your use of the Service at any time by deleting your Account and all copies of App on your devices. Merely deleting the App from your devices will not delete your Account or remove any User Submissions. In order to delete your account and terminate this Agreement, contact us at support@mymoneystory.com. At any time, for any reason, and without warning, My Money Story may terminate this Agreement and/or terminate or suspend your access to the Service or your Account, which may result in the forfeiture and destruction of all information associated with your Account. My Money Story may also terminate this Agreement and/or terminate or suspend your Account and any your access to the Service immediately, without prior notice or liability, if you breach any of the terms or conditions of this Agreement. At My Money Story’s discretion, termination of your Account will be effective immediately, promptly after notice of termination (delivered by either you or My Money Story), or at the end of the calendar month in which notice of termination is delivered. Upon termination of your Account, your right to use the Service and any Content will immediately cease.
Upon any termination of this Agreement by you or My Money Story, My Money Story will refund a pro-rata portion of prepaid but unused fees (if any) as of the effective date of the termination.
All provisions of this Agreement that should survive termination by their nature will survive termination of this Agreement. Such provisions include, without limitation, ownership provisions, warranty disclaimers, and limitations of liability.
Miscellaneous. The failure of either party to exercise, in any respect, any right provided for herein shall not be deemed a waiver of any further rights hereunder. My Money Story shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond My Money Story’s reasonable control. If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable. This Agreement is not assignable, transferable or sublicensable by you except with My Money Story’s prior written consent. My Money Story may transfer, assign or delegate this Agreement and its rights and obligations without consent. Both parties agree that this Agreement is the complete and exclusive statement of the mutual understanding of the parties and supersedes and cancels all previous written and oral agreements, communications and other understandings relating to the subject matter of this Agreement, and that all modifications must be in a writing signed by both parties, except as otherwise provided herein. No agency, partnership, joint venture, or employment is created as a result of this Agreement and you do not have any authority of any kind to bind My Money Story in any respect whatsoever. There are no third party beneficiaries to this Agreement. Headings for each section have been included above for your convenience, but such headings do not have any legal meaning, and may not accurately reflect the content of the provisions they precede.
Governing Law; Jurisdiction. This Agreement shall be governed by and construed in accordance with the laws of the State of New York without regard to the conflict of laws provisions thereof. Any dispute arising from or relating to the subject matter of this Agreement shall be finally settled in the state and federal courts in Kings County, New York, and the parties consent to exclusive jurisdiction and venue therein; provided that with respect to circumstances requiring temporary or preliminary injunctive relief to prevent harm to My Money Story, My Money Story may seek such relief in any court with jurisdiction over the parties. You agree that you must file any claim or cause of action arising against My Money Story from the use of the Service within one (1) year of the claim or cause of action arising. You acknowledge and agree that any delays to the filing of the claim or cause of action will be forever and entirely barred.
